Federal Court to hear Putrajaya’s appeal against The Edge

The Federal Court will hear Putrajaya’s appeal against the decision of a lower court to allow The Edge Communications Sdn Bhd to claim damages for loss suffered during a three-month suspension in 2015.

This follows the decision of the three-man bench to allow the leave application by the Home Ministry without contest.

Federal Counsel Alice Loke told the panel chaired by Chief Judge of Malaya Datuk Seri Zulkefli Ahmad Makinudin that publisher, The Edge Communications, was not objecting to the three questions posed by the government.

“Leave is granted as per order in terms,” Zulkefli said.

Lawyer Raja Eileen Soraya Raja Aman confirmed that her client also preferred the court to hear the merit of the appeal.

On Aug 30 last year, the Court of Appeal dismissed the Home Ministry’s appeal against a High Court order to assess damages The Edge suffered when it could not publish its business dailies.

The Edge Financial, daily and weekly editions, were suspended on July 27, 2015, following their reports on 1Malaysia Development Berhad (1MDB).

The suspension was made under Section 7 of the Printing Presses and Publications Act.

The Home Ministry claimed the articles on 1MDB were prejudicial to public order, national security and likely to alarm public opinion.

The suspension was cut short at the High Court on September 21, 2015. The Court allowed the business newspaper’s judicial review to quash the three-month suspension.-25/1/2017
